B2C General Terms and Conditions of Sale

PREMISES

These General Terms and Conditions of Sale govern distance sales contracts concluded between consumers and the company Fratelli Bonella S.r.l., with registered office in Milan (MI), C.so Plebisciti 15 and operational headquarters in Cusano Milanino (MI), Via Verdi 12, VAT No. [●], registered with the Monza and Brianza Chamber of Commerce.

The contracts are deemed concluded exclusively through the website retail.fratellibonella.it, owned by the same company.

These terms and conditions are drafted in compliance with Legislative Decree no. 70/2003 (electronic commerce) and Legislative Decree no. 206/2005 (Consumer Code), applicable to all Customers qualifying as consumers (natural persons purchasing for purposes unrelated to their business, commercial, artisanal or professional activity).

ART. 1 - DEFINITIONS

1. Seller: Fratelli Bonella S.r.l.
2. Customer: any natural person purchasing for personal purposes.
3. General Conditions: these contractual terms and conditions applicable to online sales.
4. Contract: the sales contract entered into between the Seller and the Customer.
5. Website: retail.fratellibonella.it
6. Purchase Order: the purchase proposal submitted by the Customer.
7. Order Confirmation: the e-mail through which the Seller accepts the order.
8. Products: tangible goods offered for sale on the website.

ART. 2 - SUBJECT OF THE CONTRACT

These terms and conditions govern the online sale of religious, neutral or customized items, including gift items, printed materials and liturgical products.

ART. 3 - PRODUCT INFORMATION

1. Each product is accompanied by a description and indicative images.
2. The Seller reserves the right to modify, update or withdraw products at any time without prior notice.

ART. 4 - PRICES AND SHIPPING COSTS

1. All prices are indicated in Euros and include VAT and shipping costs within Italy, unless otherwise specified.
2. International shipping costs are calculated according to destination and product volume/weight.
3. Prices may be subject to changes, but orders are confirmed at the price in force at the time the order is placed.
4. Any discounts or promotions are highlighted on the website.

ART. 5 - PURCHASE ORDER AND CONCLUSION OF THE CONTRACT

1. The Customer may purchase Products by registering on the website or as a guest.
2. The order is completed by clicking on “ORDER WITH OBLIGATION TO PAY”.
3. The Contract is deemed concluded upon the Seller sending the order confirmation by e-mail.
4. Orders will be fulfilled in a single shipment: the entire order will follow the delivery time of the product with the longest lead time among those selected.

ART. 6 - PAYMENT

1. The accepted payment methods are indicated on the website (credit card, bank transfer, PayPal, others).
2. In the event of payment by advance bank transfer, the order shall be considered accepted only upon actual receipt of the amount in the Seller’s bank account. From such date, the terms for processing and shipping the order pursuant to point 7.1 shall commence.

ART. 7 - DELIVERY

1. The products shall be shipped to the address indicated by the Customer within 5 working days from order confirmation (or from receipt of the bank transfer in the event of advance payment), unless otherwise indicated. Shipment shall be made in a single delivery and timing shall follow the provisions set out in point 5.4.
2. Delivery is made by express courier, normally within 24/48 hours within the national territory.
3. In the event of failure to collect the shipment, it shall be the Customer’s responsibility to arrange a new delivery.
4. The Seller shall not be liable for delays caused by force majeure events (e.g. strikes, natural events).

ART. 8 - LEGAL GUARANTEE OF CONFORMITY

1. The products sold through the website retail.fratellibonella.it are covered by the legal guarantee of conformity provided for by Articles 128-135 of Legislative Decree no. 206/2005 (Consumer Code).
2. To activate the guarantee, the Customer may contact the Seller at the e-mail address indicated on the website, providing proof of purchase and a description of the defect found.

ART. 9 - RIGHT OF WITHDRAWAL

1. The Customer has the right to withdraw from the contract, without giving any reason, within 14 days from receipt of the products.
2. To exercise the withdrawal right, the Customer must send written communication (including by e-mail) or use the standard form available on the website.
3. The Customer must return the products within 14 days from communicating the withdrawal, at their own expense, intact and in the original packaging.
4. The Seller shall refund the price paid, including standard shipping costs, within 14 days from the communication, but may withhold the refund until receipt of the goods or proof of shipment.
5. The right of withdrawal does not apply to: customized goods made upon customer request.

ART. 10 - APPLICABLE LAW

The contract is governed by Italian law, with particular reference to the Consumer Code and Legislative Decree no. 70/2003.

ART. 11 - JURISDICTION

For any civil dispute relating to contracts concluded with consumers, jurisdiction shall lie with the court of the place of residence or domicile of the consumer.
